Terms & Conditions

By booking a session with The Moving Studio you (the client) agree to the following Terms and Conditions. These terms are governed by the laws of New South Wales, Australia and are in accordance with the Australian Consumer Law (ACL).

1. BOOKINGS & PAYMENT

  • No deposit is required to secure a booking. However, the full session fee must be paid no later than 24 hours prior to the booked session time.

  • If payment is not received within this timeframe, your session may be cancelled 

  • Upon completion of the booking form, a booking confirmation, as well as an invoice will be sent to your nominated email address. 

  • Payments can be made via bank transfer.

 

2. CANCELLATIONS & RESCHEDULING

  • Cancellations made more than 24 hours before the session start time are free of charge (full refund will be given if payment already made).

  • Cancellations made less than 24 hours before the session start time will be non-refundable. 

  • In the case of illness, bad weather, or other unforeseen circumstances, we will work with you to reschedule your session at a mutually agreed time.

  • If we (the Photographer) are unable to fulfil the session due to circumstances beyond our control, a full refund or reschedule will be offered.

 

3. SESSION DETAILS

  • Clients are responsible for ensuring the space provided (home or venue) is suitable for a mobile studio setup (approx. 3m x 3m clear area indoors).

  • Pets and children must be supervised by an adult during sessions.

 

4. IMAGE DELIVERY & EDITING

  • A private online gallery will be provided within 1-2 weeks of your session.

  • Final images are professionally edited and delivered in high resolution JPEG format.

  • Raw/unedited files will not be supplied.

  • Reasonable retouching is included (e.g. blemishes, light skin smoothing). Additional editing requests may incur a fee.

 

5. COPYRIGHT & IMAGE USAGE

  • All images remain the copyright of the photographer and may not be altered or sold by the client without written permission.

  • Clients are granted personal use rights to print, share, and display their images for non-commercial purposes.

  • With your permission, The Moving Studio may use selected images for portfolio, website, social media, or promotional materials. You can opt out at any time by notifying us in writing.

 

6. LIABILITY & INDEMNITY

  • While all care is taken during the session, we are not liable for any injury, loss, or damage sustained during the session to persons or property.

  • In accordance with Australian Consumer Law, if there is a major failure with the service, you are entitled to a remedy such as a refund or re-shoot.

 

7. PRIVACY

  • Your personal information is handled in accordance with the Privacy Act 1988 (Cth) and will only be used to manage your booking, deliver services, and provide updates.

  • We do not sell or share your information with third parties.

 

8. AGREEMENT

By booking a session, you acknowledge that you have read, understood, and agreed to these Terms & Conditions. These may be updated periodically, and the most recent version will always be available on our website.
